Humbear Media does not provide medical, legal, or clinical advice. All Services are provided for operational, marketing, and administrative purposes only.

4. User Responsibilities

You agree that you are solely responsible for:

Maintaining the confidentiality and security of your account credentials
All activities conducted through your account
Ensuring compliance with all applicable laws and regulations, including but not limited to HIPAA, TCPA, CAN-SPAM, state privacy laws, advertising regulations, and platform-specific policies
Obtaining all required consents for SMS, email, tracking, cookies, and communications

You acknowledge that compliance is a shared responsibility, and improper configuration or misuse of the Services is solely your responsibility.

5. Prohibited Uses

You may not use the Services to:

Send spam, unsolicited messages, or unlawful communications
Violate privacy, advertising, or data protection laws
Transmit malicious code, malware, or harmful software
Infringe upon intellectual property or proprietary rights
Engage in fraudulent, deceptive, or abusive practices

We reserve the right to suspend or terminate access for violations.

Use of HIPAA-regulated features without a signed BAA is prohibited. Humbear Media is not responsible for PHI entered or transmitted in violation of these requirements.

All content, software, designs, workflows, trademarks, logos, and materials related to the Services are owned by or licensed to Humbear Media and are protected by U.S. and international intellectual property laws. No rights are granted except as expressly stated.

10. Limitation of Liability

Total liability, if any, shall not exceed the amounts paid to Humbear Media in the preceding twelve (12) months.
